Employee Management Support in Bangladesh

Practical support for managing people day to day, from attendance and leave to discipline and lawful exits.

Quick answer

Employee management in Bangladesh is the day-to-day handling of the employment relationship after hiring: tracking attendance and leave, confirming probationers, reviewing performance, managing grievances and discipline, and ending employment lawfully. It must follow the Bangladesh Labour Act 2006 and Labour Rules 2015, especially the rules on leave entitlements, show-cause and inquiry procedure, and notice and termination benefits.

Employee management is where most employment disputes in Bangladesh begin. A worker is marked absent without explanation, leave is refused without a record, a show-cause letter is issued with no inquiry, or someone is told not to come back from tomorrow. Each of these may seem minor at the time but can lead to a complaint to DIFE or a case in the Labour Court.

This page is for owners, line managers and HR officers who need guidance and practical tools for managing people through the employment lifecycle. It sits between our HR services page, which covers monthly administration, and HR solutions, which covers policy, service rules and system design.

Attendance and leave management

The Bangladesh Labour Act 2006 sets minimum leave entitlements that every employer must track: casual leave, sick leave on medical grounds, annual leave with wages earned through days worked, festival holidays and maternity benefit for eligible women workers. Unused annual leave may be accumulated or encashed within the limits of the Act, and that encashment becomes a payroll and tax item.

A reliable attendance system, whether biometric or manual, should feed leave balances and payroll directly. When attendance is disputed, the employer's own records are the main evidence.

  • Leave policy that meets or exceeds statutory minimums
  • Leave application, approval and balance records
  • Absence follow-up letters for unauthorised absence
  • Maternity benefit planning and notification

Probation, confirmation and performance

Section 4 of the Act limits probation to six months for clerical workers and three months for other workers, with a possible extension for skilled workers in limited circumstances. If an employer neither confirms nor ends probation in time, the worker is treated as permanent. A confirmation tracker prevents this from happening by accident.

Performance reviews do not have a statutory format, but documented objectives and feedback make later decisions on increments, promotion or separation much easier to justify.

Discipline and grievance handling

Dismissal for misconduct is only lawful if the procedure in Section 24 of the Labour Act is followed: written allegations, an opportunity to explain, an inquiry where the worker can defend themselves and a written decision approved by the employer or manager. Suspension during inquiry has its own rules on subsistence allowance. Skipping any step exposes the employer to reinstatement or compensation orders.

Workers also have a right to raise grievances. Clear grievance channels, and a properly constituted harassment complaint committee, resolve many issues before they escalate.

Ending employment lawfully

The Act distinguishes between resignation, retirement, discharge on medical grounds, retrenchment, dismissal for misconduct and termination by the employer otherwise than for misconduct. Each route carries different notice periods and benefits. For example, termination of a permanent worker under Section 26 requires notice or pay in lieu plus compensation linked to years of service, while a permanent worker who resigns must give notice and may be entitled to a benefit depending on length of service.

Final dues must be paid within the period the Act prescribes, together with leave encashment, fund balances and any gratuity, and with salary tax correctly settled.

Common employee management mistakes

  • Treating long unauthorised absence as automatic resignation without notices
  • Probation silently running past the legal limit
  • Dismissal without inquiry or with a biased inquiry officer
  • Final dues delayed until the worker signs a waiver
  • No written record of warnings or performance discussions

How the process works

  1. Lifecycle reviewWe review how attendance, leave, probation, discipline and exits are currently handled and documented.

  3. Manager guidanceLine managers get short written procedures for absence, leave approval, warnings and grievances.
  4. Case supportFor live issues such as misconduct or redundancy, we advise step by step and draft the documents.
  5. Exit and settlementWe calculate final dues and prepare release documentation for each separation.

Frequently asked questions

How much leave are workers entitled to in Bangladesh?

The Labour Act 2006 provides casual leave, sick leave, annual leave earned according to days worked, festival holidays and maternity benefit for eligible women. The exact entitlements differ for some sectors, and many employers offer more generous terms in service rules. Your policy should never fall below the statutory minimum.

How long can probation last in Bangladesh?

Under Section 4 of the Labour Act, probation is up to six months for clerical work and three months for other work, with an extension possible for skilled workers in limited cases. If the employer does not act by the end of probation, the worker is deemed permanent.

What is the correct procedure to dismiss for misconduct?

Section 24 requires a written charge, an opportunity for the worker to explain, an inquiry where the worker can be heard and present a defence, and a written order. The inquiry must be fair and completed within the time the Act allows. Without this procedure, dismissal can be overturned.

Can I terminate a permanent worker without giving a reason?

Section 26 allows termination otherwise than for misconduct, but only with the prescribed written notice or wages in lieu, plus compensation based on length of service. It cannot be used to punish union activity or to avoid a misconduct inquiry. Seek advice before using it.

Is a worker who stops coming to work deemed to have resigned?

Only after the employer follows the procedure for unauthorised absence: written notices asking the worker to explain and return, and a reasonable opportunity to do so. Only then may the worker be treated as having lost the job. Simply removing the name from the register is risky.
