Workforce Planning and Structuring in Bangladesh

Decide how many people you need, on what terms, and what each hire really costs under Bangladesh law.

Quick answer

Workforce support in Bangladesh means planning the size, mix and legal structure of your staff before you hire: choosing worker categories under Section 4 of the Bangladesh Labour Act 2006, costing salary, bonuses, provident fund and gratuity, mapping duties that start at specific headcounts, and setting up payroll TDS under the Income Tax Act 2023 so growth stays compliant and affordable.

Workforce decisions in Bangladesh are usually made in a hurry: a contract is won, a factory line opens, a foreign parent approves a budget, and people are hired before anyone has decided whether they should be permanent, probationary, temporary or contract staff. The result is a workforce that costs more than planned and carries obligations nobody budgeted for.

This page is for founders, finance heads and country managers who want to plan headcount properly. It covers the strategic layer: classification, true cost of employment, thresholds that trigger extra legal duties and the choice between direct hiring and third-party staff. Day-to-day rostering, payroll runs and recruitment are covered on their own pages.

Why workforce planning matters under Bangladesh labour law

The Bangladesh Labour Act 2006 (as amended) and the Bangladesh Labour Rules 2015 attach different rights to different kinds of workers. A permanent worker has notice, termination benefit and leave entitlements that a casual or temporary worker does not. Getting the classification wrong cannot be fixed by the wording of an appointment letter; inspectors from the Department of Inspection for Factories and Establishments (DIFE) and the Labour Court look at the actual nature of the work.

A plan written before hiring lets you match each role to the right category, budget the full cost and avoid disputes when the business changes direction.

  • Permanent roles for continuing core work, after probation
  • Probationers, with the probation length the Act allows for clerical and other workers
  • Temporary or seasonal workers for work that is genuinely time-bound
  • Apprentices engaged for training, not to fill regular posts
  • Third-party staff supplied by a contractor registered for outsourcing

The true cost of a workforce in Bangladesh

Gross salary is only the visible part. A realistic cost model adds festival bonuses required by the Labour Rules, overtime at the statutory rate, leave encashment, employer contributions to a provident fund if you run one, gratuity or termination benefits accruing each year, group insurance where the headcount requires it, and the Workers' Profit Participation Fund for companies that fall within its scope.

On the tax side, salary is deductible for the company, but the employer must withhold tax at source on salaries under the Income Tax Act 2023, deposit it to the government and file withholding returns. Certain benefits are taxable perquisites in the employee's hands, so the way a package is structured changes the employee's take-home pay and your compliance workload.

Headcount thresholds that change your obligations

Several Labour Act duties switch on only when an establishment reaches a certain number of workers. Growing from 40 to 120 people can quietly create new committees, facilities and insurance requirements. The exact thresholds are set in the Act and Rules and should be checked against your sector, but the main categories are:

  • Safety committee and participation committee requirements for larger establishments
  • Group insurance for establishments above the prescribed number of permanent workers
  • Canteen, childcare room and welfare facilities linked to worker numbers
  • Workers' Profit Participation Fund for companies meeting the paid-up capital or asset tests
  • Formal service rules, which may be framed by the employer and submitted to DIFE

Direct employment, contract staff or a mix?

Many businesses use a core of permanent employees and a flexible layer of contract or outsourced staff. That can work, but Section 3A of the Labour Act requires outsourcing contractors that supply workers to be registered, and a principal employer that uses unregistered suppliers or disguises core employees as contractor staff takes on risk. Payments to staffing contractors also attract VAT and withholding tax, so the cost comparison must be made on an all-in basis.

Foreign-owned companies have a further layer: expatriate managers need work permits from BIDA, BEZA or BEPZA depending on where the company operates, and the authorities look at the ratio of local to foreign staff when approving them.

Common workforce planning mistakes

  • Keeping workers on rolling temporary contracts for continuing jobs
  • Budgeting gross salary only and ignoring bonuses, gratuity and termination benefits
  • Crossing a headcount threshold without setting up the required committee or insurance
  • Hiring foreign staff before checking work permit eligibility and local-to-foreign ratios
  • Using a staffing supplier without checking its Section 3A registration and VAT status

How the process works

  1. Review the business planWe map the roles your operations actually need over the next 12 to 36 months, by function and location.
  2. Classify each roleEach position is matched to a worker category under the Labour Act and to direct or third-party engagement.
  3. Build the cost modelWe calculate the all-in employer cost per role, including bonuses, overtime assumptions, funds, benefits and tax withholding workload.
  4. Map compliance triggersWe flag the headcount points where committees, insurance, welfare facilities or funds become mandatory.
  5. Plan foreign staffingWhere expatriates are needed, we check work permit routes and local staffing ratios before recruitment starts.
  6. Hand over a workforce planYou receive a written plan, a costing workbook and a compliance calendar your HR and finance teams can follow.

Typical timeline: A workforce plan for a small or mid-sized business typically takes two to four weeks, depending on how quickly organisational and salary data is shared and how many sites are involved.

Frequently asked questions

What is workforce planning in a Bangladesh context?

It is deciding in advance how many people you need, in which roles and on which legal terms. In Bangladesh that means aligning each role with a worker category in the Labour Act 2006, costing statutory benefits and bonuses, and checking which duties apply as headcount grows, rather than simply setting a salary budget.

Can I keep employees on temporary contracts indefinitely?

Not safely. The Labour Act defines a temporary worker by the nature of the work, which must be essentially temporary and likely to end within a limited period. If someone does continuing core work for a long time, a Labour Court may treat them as permanent, with full termination benefits, regardless of the contract label.

How much does an employee cost on top of salary?

It depends on the package and sector. Typical additions are festival bonuses, overtime, leave encashment, provident fund contributions if you run a fund, gratuity or termination benefit accruals, group insurance and possibly WPPF. We prepare a cost model using your actual salary structure rather than a generic percentage.

Do foreign companies need a local entity to build a workforce in Bangladesh?

To employ staff directly and sponsor work permits, a foreign business usually needs a registered presence such as a subsidiary, branch or liaison office. Without one, options include contractors or an employer-of-record style arrangement, each with tax and permanent establishment considerations to review first.

Is this the same as workforce scheduling?

No. Workforce planning decides headcount, mix and cost. Workforce scheduling deals with shifts, rosters, working hours, weekly holidays and overtime for the people you already have. Both need to respect the Labour Act, and we offer them as separate services, though a good plan makes scheduling much easier.
