Remote employees in Bangladesh are staff who work from home or another location rather than the employer's premises. A Bangladesh company employing them remains bound by the Bangladesh Labour Act 2006 where they are workers, and must deduct salary tax under the Income Tax Act 2023. A foreign company hiring Bangladesh-based staff must also consider contractor status, permanent establishment risk and receiving payments through banking channels.
Remote employees in Bangladesh fall into two situations that need different answers. The first is a Bangladeshi company letting some or all staff work from home: the employment relationship is local and the question is how to apply local rules to a remote setting. The second is a foreign company that wants to hire talented people in Bangladesh without opening an office here.
This page is for both. It explains contracts, working time, payroll tax and data security for remote staff, and the options a foreign business has for engaging Bangladesh-based people: independent contractors, an employer-of-record style arrangement through our professional employment service, or its own registered entity in Bangladesh.

Remote work for Bangladesh employers
The Labour Act was written with physical workplaces in mind, but its protections follow the worker. Remote staff who are workers under the Act keep their rights to leave, wage payment on time, festival bonuses where eligible and lawful termination. A written remote work policy should set working hours, availability, how overtime is approved, equipment, expense reimbursement and how attendance is recorded.
Salary for remote staff is taxed in exactly the same way as for office staff. The employer deducts tax at source monthly, and any internet or equipment allowance should be treated according to the current rules on salary and perquisites.
- Remote work clause or addendum to the appointment letter
- Online attendance and working-hour records
- Company equipment loan agreement
- Data security and confidentiality rules
- Clear overtime approval to avoid unrecorded extra hours
Foreign companies hiring remote staff in Bangladesh
A foreign company with no registered presence cannot run a Bangladesh payroll in its own name or sponsor work permits, and paying people informally creates problems for both sides. Common options are to engage individuals as independent contractors, to engage them through a Bangladesh employer that handles employment and payroll, or to register a subsidiary or branch.
Each option has a tax dimension. A person who is in substance an employee but labelled a contractor may later claim employment rights. A foreign company whose Bangladesh staff negotiate or conclude contracts, or work from a fixed place under the company's control, may risk creating a permanent establishment and becoming liable to Bangladesh corporate tax. Where a tax treaty applies, its permanent establishment article should be reviewed.
Our practical advice is to decide the structure deliberately rather than by default. A single contractor for a short project is usually fine; five full-time people working exclusively for you for years look like employees and deserve a proper employment arrangement.

Getting paid: foreign remittance and tax for the individual
Bangladesh residents are taxed on worldwide income. A remote employee or contractor paid from abroad should receive funds through a bank or authorised channel in line with Bangladesh Bank's foreign exchange rules, keep encashment certificates, and declare the income in the annual return. Certain foreign remittance and freelancing income may qualify for exemptions or concessions under the Income Tax Act 2023, depending on the nature of the work and current law, so the facts must be checked before assuming an exemption applies.
Remote employee risks to manage
- Misclassifying long-term, full-time staff as contractors
- No record of hours, making overtime claims hard to defend
- Company data stored on personal devices without controls
- Payments through informal channels instead of banks
- Foreign employer creating a taxable presence without realising it
How the process works
- Understand your modelWe identify whether you are a local employer going remote or a foreign business engaging Bangladesh-based people.
- Choose the structureWe compare direct employment, contractor, employer-of-record style engagement and entity set-up for your situation.
- Document the arrangementRemote work policies, appointment letters or contractor agreements are drafted for Bangladesh law.
- Set up payroll and paymentsSalary TDS, bank payment routes and, for foreign payers, remittance documentation are put in place.
- Review periodicallyWe revisit the structure as headcount grows, roles change or permanent establishment risk increases.
Typical timeline: A remote work policy and document set typically takes one to two weeks; structuring for a foreign company depends on the chosen route, and entity registration timelines depend on RJSC and BIDA processing.

Frequently asked questions
Does the Labour Act apply to employees working from home?
If the person is a worker under the Act, their rights do not disappear because they work remotely. Leave, wage payment timelines, notice and termination benefits still apply. Senior managerial staff may fall outside the definition of worker, and then their contract governs.
Can a foreign company employ staff in Bangladesh without an entity?
Not directly as a local employer. Without a subsidiary, branch or liaison office it cannot run a local payroll or sponsor work permits. Options are contractors, engagement through a Bangladesh employer providing employer-of-record style services, or registering its own entity.
Do remote employees in Bangladesh pay income tax?
Yes. Resident individuals are taxed on their worldwide income. If a Bangladesh employer pays the salary, it deducts tax at source. If a foreign client pays, the individual must declare the income in the annual return; some foreign remittance or freelancing income may qualify for concessions under current law.
What is permanent establishment risk?
It is the risk that a foreign company's activities in Bangladesh, for example staff habitually concluding contracts or working from a fixed place under its control, create a taxable presence. The company could then owe Bangladesh corporate tax on profits attributable to that activity.
How should remote staff record working hours?
Use an online timesheet, login records or an HR system that logs start and end times and approved overtime. These records support payroll and salary TDS, help defend against overtime claims under the Labour Act, and let managers spot overwork or under-performance early, without intrusive monitoring of the employee's personal life.
Should remote employees receive an internet or home office allowance?
It is not mandatory under the Labour Act, but many employers pay one or reimburse actual costs. Decide the approach in the remote work policy and check how the payment is treated under the Income Tax Act 2023 rules on salary and perquisites, so payroll deducts the right tax.
